Welcome to the website for Zouk S.E.A (South East Asia)(“Festival”), owned and operated by Tanoc Enterprise (Company No. 202403214145 (IP0599732-V))(“Company”), registered with the Companies Commission of Malaysia (SSM), is based in Malaysia. The Company appointed committee (“we,” “our,” or “us”) to oversee the organisation and execution of the Festival. By accessing, browsing or purchasing products or services through ‘zouksea.com’(“Website”), you agree to comply with these Terms of Service (“Terms”). If you do not agree, you must discontinue your use of this Website immediately.
1. Scope of Services
1.1 Event Scope
The Festival is a dance-focused event that includes workshops, social dance sessions, and other activities as explicitly outlined in the event program.
1.2 What We Provide
We provide sales services relating to the event, organise the event schedules such as workshops, social dance parties, performances, and organise access to designated event venues during official event hours. Event-related updates will be communicated via this website, email or social media platforms.
1.3 What Is Not Included
Travel, accommodation and meals are not included unless expressly stated in the sales package. Additional or unscheduled activities outside the published program. Personal insurance coverage for injuries, accidents, or losses. Liability for third-party events or services not affiliated with Tanoc Enterprise, even if it takes place in the same premises of the Festival.
2. Use of Website
2.1 Acceptable Use
You agree to use the Website solely for lawful purposes and to purchase products, services or gather event information.
2.2 Prohibited Use
Engaging in fraudulent activities, including reselling event passes without written permission are not allowed. Unauthorized reproduction or use of Website content, including logos, designs, and text as well as data mining or interfering with the Website’s operation are prohibited.
3. Product and Services Purchases
3.1 Payment and Pricing
All prices are listed in United States Dollar (USD), and may include applicable taxes and processing fee, unless otherwise stated. Payments are processed securely through third-party gateways. We are not responsible for issues arising from third-party payment failures. In the even that the payment failed to transfer, the purchase will be considered void. Please ensure that your passport or identification documents are valid for entry into Malaysia before purchasing passes, we will not take responsibility if your documents prevent you from reaching the Festival. You must be at least 18 years of age to make purchases on this website.
3.2 Refund and Cancellation Policy
All sales are non-refundable except in cases where the event is cancelled by the Company. Postponed events: Passes will remain valid for the rescheduled dates.
3.3 Pass Validity and Transfers
Passes are valid only for the specified event dates and activities. Passes possess their own Terms and Conditions, please read them carefully to ensure that your attendance is unaffected. Passes may not be resold, transferred, or tampered with without prior authorisation. Passes and entry can be revoked without prior notice at the behest of the organisers.
4. Assumption of Risk
By attending the festival, you agree to the following risks:
4.1 Inherent Risks
Dance Activities: Participation in dance workshops, social dances, performances, competitions involve risks such as physical injuries, muscle strain, accidents or potentially life-threatening situations. Attendees are responsible for monitoring their own health, safety and being vigilant of their surroundings. Bright Lights and Noise: Certain activities may feature bright or strobe lighting and loud music, which can trigger seizures, light sensitivity, or discomfort. Individuals with such conditions should take precautions. Substance Use: The Company is not responsible for the consequences of any attendee consuming alcohol, drugs, or other substances before, during, or after the event and the consequences of their use.
4.2 Venue and Environmental Risks
The venue may include uneven flooring, wet floors, stairs, or other environmental hazards. Exercise caution at all times. Any activities outside the official event programme, even within the same venue, are not the responsibility of Tanoc Enterprise or the appointed committee.
4.3 Personal Property
You are solely responsible for your belongings. The Company is not liable for theft, loss, or damage to personal items during the event.
5. Limitation of Liability
Event-Related Incidents: The Company and its organisers are not liable for injuries, damage, or losses resulting from participation in the Festival unless caused by gross negligence. External Activities: The Company is not liable for incidents occurring during activities that is not part of the programme’s itinerary, even if they take place on the same premises. Third-Party Services: We are not responsible for the actions, products or services of third-party vendors, such as invited instructors, guest facilitators, food and beverage vendors, hotels, transportation providers, or external event organisers. In the event the third-party vendors are not able to be at the Festival to perform their duties as announced, we have the right to replace them and will not be liable for any inconvenience caused.
6. Force Majeure
Tanoc Enterprise is not responsible for delays, modifications, or cancellations caused by events beyond its reasonable control, including but not limited to natural disasters, government regulations, pandemics, or other unforeseen circumstances.
7. Intellectual Property Rights
All content on this Website, including text, graphics, logos, and images, is the property of Tanoc Enterprise or its licensors. Reproduction, distribution, or modification of any content without prior written consent is strictly prohibited.
8. Amendments to Terms
We reserve the right to update these Terms at any time unannounced. Significant changes will be communicated via email or a notice on the Website or on our social media platforms. Your continued use of the Website constitutes acceptance of the revised Terms.
9. Governing Law and Jurisdiction
These Terms are governed by the laws of Malaysia. Any disputes will be resolved exclusively in the courts of Malaysia.
